The Prosecutor`s Office of Bosnia and Herzegovina has issued an order to the judicial police for the detention of the President of the Republika Srpska entity, Milorad Dodik, Prime Minister Radovan Višković, and the Speaker of the RS National Assembly, Nenad Stevandić.

The order was issued by prosecutor Ćazim Hasanspahić, and the Prosecutor`s Office accuses them of committing the criminal offense of “attacking the constitutional order.“ The order for their detention was given to the judicial police, with a request for assistance from the RS Ministry of the Interior and SIPA (State Investigation and Protection Agency).

Milorad Dodik`s lawyer, Goran Bubić, stated yesterday that, as the legal representative of the RS President, he is not aware of any summons being officially delivered to the RS President by the “unconstitutional“ Prosecutor`s Office of BiH in accordance with the applicable Criminal Procedure Code (ZKP).

My suggestion, and even my request, is that my fellow prosecutors truly pay attention to the fact that Schmidt was not confirmed by the UN Security Council,“ Bubić said.

The 19th issue of the Official Gazzette of Republika Srpska contains decrees on the proclamation of four laws adopted by the RS National Assembly in a special session on February 27:

  • Law on Non-Implementation of Laws and Prohibition of the Activities of Unconstitutional Institutions of BiH;
  • Law on the High Judicial and Prosecutorial Council of Republika Srpska;
  • Law on Amendments to the Republika Srpska`s Criminal Code;
  • Law on the Special Register and Public Transparency of Non-Profit Organizations.

According to RS leadership, these laws effectively ban the activities of the Court and Prosecutor`s Office of BiH, SIPA (State Investigation and Protection Agency), and the HJPC (High Judicial and Prosecutorial Council of BiH).

The Constitutional Court of BiH has temporarily suspended these laws.
