The Speaker of the House of Representatives of the Parliamentary Assembly of BiH, Denis Zvizdić, commented on the annulment of the Law on the High Judicial and Prosecutorial Council (HJPC) of Republika Srpska.
The Constitutional Court of BiH also annulled the Rulebook on the Procedure for Nominating and Electing the First Members of the HJPC of Republika Srpska.
“These are very important decisions—not only for this case but for all future cases as well—because the Constitutional Court has permanently established the principle that once a competence is transferred from an entity to the state, it cannot be unilaterally ‘taken back’,” stated Zvizdić.
He also expressed satisfaction with the fact that the controversial Rulebook on the Procedure for Nominating and Electing the First Members of the HJPC of Republika Srpska was also annulled, as its adoption was an attempt to circumvent the earlier temporary decision of the Constitutional Court of BiH.
“We recognized that in time and stopped the process. We will continue to monitor all unconstitutional activities of the National Assembly of Republika Srpska, and whenever necessary, we will use all legal mechanisms to protect the institutions of Bosnia and Herzegovina,” he stated.
